According to Article 40 of the "Regulations on Quality Management of Construction Projects" promulgated by the State (Decree No. 279 of the State Council of the People's Republic of China): Under normal conditions of use, the minimum warranty period for construction projects is:
1. Foundation engineering and main structure engineering of infrastructure engineering, house building, and the reasonable service life of the project specified in the design documents;
2. Anti-leakage of roof waterproofing projects, toilets with waterproof requirements, rooms and external walls is 5 years;
3, heating and cooling systems for the two heating period, cooling period;
4, electrical pipelines, water supply and drainage pipelines, equipment installation and renovation projects for 2 years.
The warranty period for other items is agreed by the contractor and the contractor. The warranty period of the construction project shall be calculated from the date of acceptance of completion.
After we learned from the above-mentioned provisions that the warranty period for various projects, it is best to compare the contents of the “Residential Quality Assurance Certificate†delivered by the developer at the time of repossession, and the specific date of the issuance of the completion acceptance document issued by the Construction Committee. Calculate the warranty expiration time for each item. At that time, we will review the relevant items again before the warranty period expires. If the developers are responsible for the part of the warranty period, they should urge them to complete the repairs within the warranty period. This will save the mind and effort and save money, otherwise, if the repair part involves other households or public parts, the trouble is even greater. It would be much better if the developer had a uniform inspection and repair of this conscious behavior before the warranty expired.
For some properties that have purchased existing buildings, especially those that have been completed for some time, the owners may have to look at the timing of their construction committee acceptance and the time of your repossession. Whether or not some of the warranty items have already passed the warranty period, if so, It is best to have an additional supplement with the developer. Otherwise, you are not legally protected!
For the construction units that have problems with the project quality or do not perform the warranty, the state also has corresponding regulations for supervision. Among them, Article 56(3) and (7) of the “Regulations on the Quality Management of Construction Projects†stipulates that the construction unit expressly or implicitly violates the mandatory standards for project construction and reduces the quality of the project; expressly or implicitly indicates that the construction unit is using it. Unqualified construction materials, construction components, accessories, and equipment shall be fined not less than 200,000 yuan but not more than 500,000 yuan unless they are ordered to change. Article 66 stipulates: If a construction unit fails to perform its obligations under warranty or delays in fulfilling its warranty obligations, it shall be ordered to make corrections, impose a fine of not less than 100,000 yuan but not more than 200,000 yuan, and bear the liability for damages caused by quality defects during the warranty period.
